So what actually happens to games you've downloaded onto a 3DS if it dies and is no longer under warranty? Are you just out of luck? Or can you buy a new 3DS and send it to Nintendo along with the old one to get the games transferred?

If you've downloaded them to the SD card, theoretically, you should be able to just use the SD card on another 3DS.
Or you could do as you said, and just send the 3DS to Nintendo and hopefully get your games replaced.

You will need to get it repaired, to transfer games onto another 3DS (Even by SD Card) You need to do a system transfer to transfer everything over onto the new 3ds. Either that or call Nintendo up, i heard that they can get you your games back.

Yeah, you can transfer between 3ds's. I was wondering specifically what would happen if you couldn't even turn the broken one on.
