Hi people,

I just have to ventilate this. I shouldn't be bothered but actually...I am. Back in 2008 I created a tribute to Rare's Banjo-Kazooie. The series was almost 10 years old and during the creation of the project Nuts and Bolts was announced. I really tried to find an original angle to the story and thought that telling the story through the eyes of Mumbo's Wand would be an original take on it.



5 years further down the line, the film still is good for asking the question if Rare's new vision on Banjo was right or not.

Last week I found out that another fangroup is creating a fan created piece of software too....and they also call it 'Mumbo's Wand"....how original is that? (link to their site)

Actually when I started digging I saw that other forumusers complained about this fact, but the creators still hold on to the name. It's such a shame because there are so many options to choose from, but hey.

I know it's only about something I was fan of, and life goes on. But I spend 6 months on that project and its originality. I got a lot of reactions from Rare and got invited to visit their studios too. But still...

Dude, do you want to be my best friend?!? I loved BKNB, but I wish it didn't have the BK brand, it just wasn't BanjoKazooie. I think you should find these people and Kick Their Sorry Breegulls!!
Also I really im enjoyed watching the video! Brought a lot of Nostalgia! Maybe I will go back and play BK and BT. For the thousandth time!

Yeah, we spend some time on getting the right feel to it, but I think it works. When I look back, I could do this project much faster and much better...but I don't think a next project will be Rare related..

 

Did you hear the rumors that Rare might change its name in 2013? It might be better, the legend will be over for good and can rest in peace.

Yeah me too, i did like Viva Pinata though. Though it could have been a bit less sweet. Rumor is that MS made yhem change it. It was the last game with Stampers input.

Hey instead of complaining about it on boards we don't even normally go to, why didn't you just contact us if you had an issue with the names being the same.  We could have just changed the name if you had such an issue with it.

 

Oh and the name was never "stolen", just a coincidence.  We aim for this program to be the Toad's Tool of Banjo-Kazooie.  So instead of Toad we had a BK supporting character instead which was Mumbo and Mumbo has a tool which is his wand.  That was our origin of the name Mumbo's Wand.

As Koolboyman pointed out we have been developing this program for about 2 years, if you had a problem with it you could have contacted me at any stage in regards to the name and we could have changed it.

 

Now with the program about to be released you have suddenly discovered it? And then when you did find it you decided to post on here about it knowing that the project is on RWC and that you could have contacted me at any point.

 

Also thanks to who ever posted under You'reAThief, you at least brang it to our attention....

Other than that, I could have contacted you but as said before, had the feeling that it wouldn't matter.

Goodluck with the project and its really original name.

Ps. MS to call its next gaming platform Playstation because, yeah, the coincident is that it is a station to play games on.

Torrentstorm had nothing had to do with developing the program, it was me Skill, Subdrag and a handful of testers.  Our fan projects have nothing in common anyway.  You made a fan video and we're making an editor that allows people to make new BK levels, someone like you should be more appreciative of but instead is doing nothing more but complaining and accusing us of being thieves.  

 

Also your Microsoft and Playstation thing makes no sense.  These are two fan projects that coincidentally had the same name that we were willing to change.  If Microsoft did that Playstation could sue.  Don't assume that every single person in the Rareware fandom knew about your project.  

 

You are completely disrespectful towards the people who have spent years developing this project... and at so close to release.  It's an extremely stressful time for me and everyone else who has a hand in this project making sure it's stable for Rare fans everywhere to make levels, and all you care about is your choice to believe that we "stole your name".

I'm not pretending that I personally didn't know about your name, you're not understanding, I've known about your video for years.  I'm saying that the name was created before that person knew of your MW, and when it was brought up to us we decided to keep it anyway because liked the name and we figured if you had an issue with it you would have just told us to change it and that would be the end of it.  We don't have an issue with our name being the same as your video after all.  Only like two people brought it up to me as well and even then they didn't seem to care that much.

 

Here's the reality of it though.  You don't own the trademark of "Mumbo's Wand".  if a third person wanted to they could make their own Mumbo's Wand project and neither of us could do anything about it, because it's Rare who owns Mumbo and his damn wand, not us.  However If I made a commercial game with the same name after you trademarked that name  then that would be a completely different ballpark and I would have to legally change the name of my commercial game whether I liked it or not.  Although I would have been nice about Mumbo's Wand anyway and just changed the name if you wanted it to.

 

Thank you for your apologies however.  Even if you didn't mean to come off as disrespectful and selfish, it appeared that way not only to me but the other people working on this project as well as the Rarewarecentral community.  Maybe I didn't act the best myself, but like I said, we're literally days away from release and we kinda don't need this.

I really didnt know about your projects name before last week and the phase your in right now. Just noticed on google how my video was suddenly lost in between all kind of mumbo wands. Didnt want to make a big point at all. I really understand the work and effort you put into it. I know I have no claiming right to the title. Please understand that i'm just looking after my baby as you would have after releasing your project. Neither did I disrespect your community so please pass that on.

I think both parties could have handled this better, you at the start and I at the end. I wish you succes on launch.

'Mumbo's Game Grumps' would be fitting

Mumbo's speech is made up of cut-up samples of Grant Kirkhope's voice that would later be used on the soundtrack of the Mayahem Temple level in Banjo-Tooie', which Kirkhope revealed in an episode of the Internet comedy Let's Play series Game Grumps is actually him saying "Come and have a go if you think you're hard enough", a famous English football chant.

But then again, I don't want you to have to much work on changing thins. So you could stick with it. Just hoped you contacted me on one point, enough people in your community know how to contact me.

Ps: i did read the comments in yor forum. They are right to certain points but, no I have to disappoint, I wasnt that one poster. I'd hope I builded up more respect but then again, sure, I could have handled this better.
