“Eternal Darkness” Trademark Extension Granted to Nintendo

Back in 2013 Nintendo filed for the registration of the trademark “Eternal Darkness,” sparking hope for the return in some form of the action adventure by Silicon Knights.

Six months after the registration of a trademark, the United States Patent and Trademark Office sends registrants a “notice of allowance” demanding a “statement of use” including evidence that the trademark is indeed being used in commerce. At that point the registrant can either provide said evidence, request an extension of the time to send the statement, or do nothing, in which case the trademark will be abandoned after further six months.

The extension request is a “sworn statement that the applicant still has a bona fide intention to use the mark in commerce, but needs additional time actually to use the mark.”

Nintendo was granted the first extension in June, and on December 17th they requested a second, which was approved on the 20th, meaning that the house of Mario and Zelda still intends to use the trademark.

They also have a limited time to actually do so, because the extension can only be requested five times, meaning that Nintendo will have to provide teh USPTO with evidence of a new Eternal Darkness project by the end of 2016, or lose the right to use the name.

They better get on it, or atleast picked up "Shadow of the Eternals" and get that going. Or maybe it should stay as only a spiritual sucessor.

That thing needs to die.

It's a GameCube quality game and shudderingly uses original GameCube assets.

It's only chance of showers chess was with early wii u hype.

And the game is now something that would lose a lot of money.

It looks... Dated.

Best released on iPhone if it ever comes out.

Well yes it looks dated, I mean with the funds it could be better. Does look better then some bits of gamecube, but I could see what you were getting at. And Devils Third looked dated, it probably won't be next gen, but it looks better not than at E3. And thats why I also said Nintendo could/should step in, the reason why the first one was good is because of Nintendos quality leash.

It looked like a PS360 game early in development it was using UE3. Can't judge a game that early on in development.

 

Anyway for all we know they just need this extenstion to re-release it with other Gamecube games. Why take so long. Well even NES takes them forver on Wii U

It looked like a PS360 game early in development it was using UE3. Can't judge a game that early on in development.

True nintendo has taken forever with their games for wii u.

But DANG. THEYVE REALLY USED THAT TIME WISELY.

Nintendo Wii U games are pure awesome.
