I'm not saying they do. But after all the money they spend on development/bug testing, how could they have missed a thing so obvious as a non-responsive touch screen, and severe difficulty even turning the thing on and off?

Well, that is included in the update, so I imagine a few game demos will be available. I hope that they have demos for the Mercenaries and Shinobi.

Well, I know they helped with a few track designs...http://iwataasks.nintendo.com/_ui/images/3ds/mariokart7/conceptart.jpg They did Neo-Bowser, Koopa City, Rosalina's Ice World and Shy Guy Bazaar, at the least.
