I really didnt know about your projects name before last week and the phase your in right now. Just noticed on google how my video was suddenly lost in between all kind of mumbo wands. Didnt want to make a big point at all. I really understand the work and effort you put into it. I know I have no claiming right to the title. Please understand that i'm just looking after my baby as you would have after releasing your project. Neither did I disrespect your community so please pass that on.

I think both parties could have handled this better, you at the start and I at the end. I wish you succes on launch.

'Mumbo's Game Grumps' would be fitting

Mumbo's speech is made up of cut-up samples of Grant Kirkhope's voice that would later be used on the soundtrack of the Mayahem Temple level in Banjo-Tooie', which Kirkhope revealed in an episode of the Internet comedy Let's Play series Game Grumps is actually him saying "Come and have a go if you think you're hard enough", a famous English football chant.

Alright glad we solved everything,  I'll let everyone on RarewareCentral know that we talked this out.  We're both Rare fans after all who want to contribute great things to the fanbase.  I'd also like to state that I loved your Mumbo's Wand when I first saw it.

Maybe I should have acted in another fashion and I will apologize for that. But...you really should not act as if you didn't know about my Mumbo's Wand. Several people on your own forums have adressed this in the very same topic as you presented your own new project.

I'm not disrespectful at all and was really willing to promote your project. Hell, I even started with a special site for Rare fanprojects and did specials on all kind of Rare projects. Simplyrare was just about that.

Don't get my wrong, I should have asked you directly but don't start about adult behaviour without looking at the situation from my point of view, and without adressing/admitting that you too could have acted on earlier fan response (as mentioned in the above paragraph).

I'm not pretending that I personally didn't know about your name, you're not understanding, I've known about your video for years.  I'm saying that the name was created before that person knew of your MW, and when it was brought up to us we decided to keep it anyway because liked the name and we figured if you had an issue with it you would have just told us to change it and that would be the end of it.  We don't have an issue with our name being the same as your video after all.  Only like two people brought it up to me as well and even then they didn't seem to care that much.

Here's the reality of it though.  You don't own the trademark of "Mumbo's Wand".  if a third person wanted to they could make their own Mumbo's Wand project and neither of us could do anything about it, because it's Rare who owns Mumbo and his damn wand, not us.  However If I made a commercial game with the same name after you trademarked that name  then that would be a completely different ballpark and I would have to legally change the name of my commercial game whether I liked it or not.  Although I would have been nice about Mumbo's Wand anyway and just changed the name if you wanted it to.

Thank you for your apologies however.  Even if you didn't mean to come off as disrespectful and selfish, it appeared that way not only to me but the other people working on this project as well as the Rarewarecentral community.  Maybe I didn't act the best myself, but like I said, we're literally days away from release and we kinda don't need this.

Now lets see, there is no coincidence in this as I developed Mumbos Wand while being active on rwp and other Rare sites. Torrentstorm, your copilot, actually followed the complete development of the animation, years before your project even started. Reading the comments of Skill and another couple of users on your own forum it was really clear for me that you could change the name but had no desire to do so.

I posted it here just to ventilate, this place is my virtual home now so yeah, I post it here.

Other than that, I could have contacted you but as said before, had the feeling that it wouldn't matter.

Goodluck with the project and its really original name.

Ps. MS to call its next gaming platform Playstation because, yeah, the coincident is that it is a station to play games on.

Torrentstorm had nothing had to do with developing the program, it was me Skill, Subdrag and a handful of testers.  Our fan projects have nothing in common anyway.  You made a fan video and we're making an editor that allows people to make new BK levels, someone like you should be more appreciative of but instead is doing nothing more but complaining and accusing us of being thieves.  

Also your Microsoft and Playstation thing makes no sense.  These are two fan projects that coincidentally had the same name that we were willing to change.  If Microsoft did that Playstation could sue.  Don't assume that every single person in the Rareware fandom knew about your project.  

You are completely disrespectful towards the people who have spent years developing this project... and at so close to release.  It's an extremely stressful time for me and everyone else who has a hand in this project making sure it's stable for Rare fans everywhere to make levels, and all you care about is your choice to believe that we "stole your name". 

Up until now we were willing to change the name, but judging by your behavior, no we're not going to change the name for you if this is how you're going to handle the situation.  Once you want to come and talk to us like adults we might reconsider but as of now I don't believe that's going to happen.

Hey instead of complaining about it on boards we don't even normally go to, why didn't you just contact us if you had an issue with the names being the same.  We could have just changed the name if you had such an issue with it.

Oh and the name was never "stolen", just a coincidence.  We aim for this program to be the Toad's Tool of Banjo-Kazooie.  So instead of Toad we had a BK supporting character instead which was Mumbo and Mumbo has a tool which is his wand.  That was our origin of the name Mumbo's Wand.
