He knew want he was going into, so he knew about the NDA could get him in trouble. What he should have did was to post on something like GoNintendo or a random place that deals with a lot of news. Post it on a forum or send it to an editor/writer owner and let them post it with secrecy of the original person.
If this rumor is true I will feel sorry for the guy and his family, and hope for the best of them. The other thing would be that this may be an indicator that this is the final controller, close to the final controller.

Well I find it is fair. Actually I am surprised that Nintendo didn't assassinate him. I swear Nintendo has assassins to fill all of the leaks.

He broke the rules so it's completely justified. Taking him to court may be going too far.

Good luck gaining enough trust to get hired again from someone else if that's how much you care about NDA agreements.
I wouldn't hire someone who so easily spilled the secrets of his last employer...
Wish him well. But that's was very wrong.
He definitely hurt nintendos "shock and awe" E3 reveal. Taking him to court wouldn't be wrong. And I doubt anyone views an NDA with Nintendo that lightly again.
Nothing wrong with justice. The guy knew the score and did it anyway.
