Apparently you can only view content rated PEGI 18+ on the eShop between 11PM and 3AM.
This is simply ridiculous.

"Thank you for your inquiry. At Nintendo we always aim to provide a safe gaming experience for fans of all ages and ensure that we comply with applicable legal age restriction requirements across Europe.
Legal age restriction requirements vary across a number of European countries. Since Nintendo of Europe is based in Germany, Nintendo eShop is complying with German youth protection regulation which therefore applies to all our European markets. Under German law, content rated 18+ must be made available only at night.
Therefore the accessibility of 18+ content in Nintendo eShop is limited to [USK: 22:00 UTC until 4:00 UTC] [PEGI: 23:00 UTC until 3:00 UTC].
Thank you for your understanding"

If it was due to where they were based then surely it would affect retail sales too?
As for downloads, their content delivery network is spread all over Europe

Surely their obligation is to block content only for people who have their console set to Germany?

This. Nintendo doesn't really have an excuse or valid reason for this.

Probably but I think NoE just doesn't want to try to get around the law. If the made it to where you set your region then couldn't those in Germany just lie and say they are from somewhere else? I just don't think Nintendo want's to take any chances on possibly breaking the law. The law in itself is stupid anyway, and I do hope they do something about it. All of Europe shouldn't be affected by this just because some German law.Surely their obligation is to block content only for people who have their console set to Germany?
